Manufacturing Defect Lawsuits and Injury Claims in South Carolina

There are many personal injury lawsuits each year regarding manufacturing defects, mainly because manufacturers will not always maintain the level of care set forth by their own company standards. When a customer uses a product for its intended purpose, that product is expected to continue operating within the company standards for a reasonable time frame. This standard of care does not always happen and may in a tragic case, lead to the injury or death of a consumer using the product correctly.

South Carolina Laws for Strict Liability and Res Ipsa Loquitur

The good news is that manufacturing defects in some cases can be more easily proven, mainly because the manufacturer has written materials that set the standard for the products. This help mainly comes from the two manufacturing defect doctrines, the first is called "res ipsa loquitur" and the second is "strict liability."

Under strict liability, if the manufacturer's product does not meet the company's own requirements, the plaintiff does not need to prove that the defendants were negligent during the creation of the product in manufacturing. While res ipsa loquitur, which in Latin simply means, "the thing speaks for itself," requires the plaintiff to prove a defect could only exist if the manufacturer were in fact negligent. These standards are in place to help the plaintiff prove there was a defect in the product.
